In October 2024, a 34-year-old accounting student, Mr J, was involved in a devastating roadside accident that resulted in a life-changing right below-knee amputation.
What Happened?
The incident occurred on the A46, a three-lane carriageway, on a dark, wet evening. Mr J was driving his Volkswagen Polo when he was involved in an initial collision with another vehicle, resulting in his car coming to a standstill adjacent to the nearside roadside barrier.
Following this, a Nissan van pulled over and remained stationary on the left-hand side of the carriageway to offer assistance. Mr J safely exited his vehicle and stood at the side of the road, speaking to the Nissan driver through the open passenger window. Suddenly, a Mercedes Vito van driven by the Defendant collided with the rear of the stationary Nissan. The sheer force of the impact shunted the Nissan forward into Mr J’s vehicle, trapping him and causing a devastating injury to his leg.
Injuries Suffered
The physical and psychological impact on Mr J was profound:
- Traumatic Amputation: He sustained a severe open fracture to his right leg, rendering the limb unsalvageable and resulting in a transtibial (below-knee) amputation.
- Pre-existing Complications: The impact of the amputation was severely compounded by a pre-existing congenital deformity in his left arm. This meant he lacked the upper-body strength typically relied upon by individuals with lower-limb amputations for transfers and mobility.
- Psychological Trauma: He suffered from severe depression, anxiety, post-traumatic stress disorder (PTSD), and flashbacks, requiring ongoing psychological counselling.
- Ongoing Physical Pain: He experienced persistent hypersensitivity, numbness in the residual limb, phantom limb pain, and chronic post-accident back pain.
Gathering the Evidence
Upon instruction in November 2024, Major Trauma Lawyers swiftly implemented a multi-disciplinary approach to support Mr J. Despite the Defendant denying liability, the legal team aggressively built a comprehensive case focusing on high-level private rehabilitation and long-term care needs.
Early Rehabilitation and Prosthetic Funding
A central focus of this case was implementing an immediate and comprehensive rehabilitation programme. By securing early interim payments, we were able to instruct a private case manager and fund a specialist multidisciplinary team. Crucially, this funding was used to design, manufacture, and fit a state-of-the-art, bespoke prosthetic limb tailored specifically to the client’s lifestyle. Alongside this, we funded the intensive private physiotherapy required to use the prosthesis effectively, completely bypassing the lengthy waiting times often experienced in the public sector.

Negotiations
The Defendant’s insurers heavily scrutinised the complex chain of events and initially disputed liability. However, the comprehensive and robust nature of the initial expert evidence gathered by our team placed significant pressure on the Defendant. This strategic litigation management forced the Defendant into making a substantial offer to settle the claim before the medical evidence was even fully finalised.
Compensation Received and Outcome
Following a conference with leading Counsel, Andrew Granville Stafford, the offer was accepted on 4th February 2026.
The total settlement achieved was £1,500,000. This life-changing result provides Mr J with the vital financial security necessary to fund advanced private prosthetics (valued at over £1.4 million over his lifetime), specialised adapted housing, and the long-term care support he requires.
