What Happened
On the 30th of March 2025, Child LW was a pedestrian crossing Rotherham Road, Barnsley, at a controlled crossing. He was struck by a Citroen Dispatch van driven by the Defendant. Following the collision, the child was pushed into the air and landed face down, requiring immediate transport to Sheffield Children’s Hospital by ambulance.
Injuries Suffered
Child LW sustained a head injury resulting in a transient loss of consciousness and amnesia, a fractured right collar bone (clavicle), a right cheek haematoma, and soft tissue bruises. Furthermore, he suffered an adverse psychological reaction, including anxiety and trauma, following the incident.
Gathering the Evidence
Comprehensive evidence was gathered, including CCTV footage of the collision, the police report, and witness statements, including one from the child’s friend who was present at the scene. Medical evidence was obtained from a Consultant Orthopaedic Surgeon, Mr M J Farhan. Recognising the importance of early intervention, we arranged for immediate psychological treatment, securing four sessions of Cognitive Behavioural Therapy (CBT) with Medico Legal Rehab Ltd .
Negotiations
A letter of claim was sent to the Defendant’s insurer on the 23rd of July 2025. The Defendant wholly denied liability in late September 2025, alleging that their insured drove through a green traffic light while the child crossed suddenly against a ‘red man’ signal. Maintaining a ‘front foot’ approach, court proceedings were issued in October 2025 to resolve the liability dispute. Following this robust litigation strategy, the Defendant made a Part 36 offer of £25,000 on the 3rd of November 2025. This was accepted subject to court approval, and the case was subsequently allocated to Intermediate Track Band 2.
Compensation Received and Outcome
The aggressive early litigation strategy yielded an exceptional result. The £25,000 settlement was officially approved at the infant approval hearing, alongside an additional £580 paid by the Defendant to cover the full costs of the psychological therapy. Crucially, this was achieved with absolutely no deductions from Child LW’s damages. The child has since made a remarkable recovery from his physical injuries and psychological symptoms.
